Terms of Service

These Terms of Service ("Terms") govern your use of SmartCert ("the Service"), operated from Ireland. By creating an account or using SmartCert, you agree to these Terms.

1. The Service

SmartCert provides an AI-powered study assistant for Leaving Certificate biology students. The service includes an AI chatbot ("Certi"), a notebook feature for saving responses, and topic-based study tools.

2. Account Registration

• You must provide accurate information when creating an account.
• You are responsible for keeping your login credentials secure.
• You must be at least 16 years old to create an account, or have parental/guardian consent.

3. Subscriptions and Payments

• Access to the AI chatbot requires a paid subscription (currently €2.99/month).
• Payments are processed securely by Stripe. We do not store your card details.
• Subscriptions renew automatically each month until cancelled.
• You can cancel your subscription at any time through the Manage Subscription page. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial billing periods.

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorised access to our systems or other users' accounts
• Send automated or scripted requests to the AI chatbot (e.g. bots, scrapers)
• Resell, redistribute, or commercially exploit the service or its content
• Interfere with the proper functioning of the service

5. AI-Generated Content

• Certi provides study assistance based on the Leaving Certificate biology syllabus. Responses are generated by AI and may occasionally contain errors.
• SmartCert does not guarantee the accuracy of AI-generated content. Always verify important information with your textbook, teacher, or official exam materials.
• AI responses should be used as a study aid, not as a sole source of information.

6. Intellectual Property

All content, branding, and software on SmartCert are owned by SmartCert or its licensors. You may not copy, modify, or distribute our content without permission. You retain ownership of any content you create (e.g. notebook entries).

7. Account Termination

We may suspend or terminate your account if you violate these Terms or engage in behaviour that harms the service or other users. You may delete your account at any time by contacting us at contact@smartcert.ie.

8. Limitation of Liability

To the maximum extent permitted by Irish law:

• SmartCert is provided "as is" without warranties of any kind.
• We are not liable for any indirect, incidental, or consequential damages arising from your use of the service.
• Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim.

9. Privacy

Your use of SmartCert is also governed by our Privacy Policy, which explains how we collect and use your data in compliance with GDPR.

10. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify users by posting the updated terms on this page. Continued use of the service after changes constitutes acceptance of the new terms.

11. Governing Law

These Terms are governed by the laws of Ireland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Irish courts.
